SECTION A:

The Cat Fuel Payback Credit is awarded to the owner of an eligible Cat machine based on fuel consumption for the specific product during the specified period. The credit is expressly in lieu of any other express or implied warranties related to the product's fuel consumption, including but not limited to any warranty of merchantability or fitness for a particular purpose. Remedies under the program are limited solely to the credit as specified in the program documentation and Caterpillar is not responsible for lost profit, downtime or any incidental or consequential damages. This disclaimer states Caterpillar's entire obligation in connection with the Fuel Payback Credit.

  1. To be eligible for enrollment in the Fuel Payback Credit program an eligible Cat machine must be (a) purchased, rented with a purchase option or leased (Caterpillar sales type 1, sales type 3 and sales type 4) between July 1, 2019 – December 31, 2019, and (b) have Cat Product Link™ installed and activated within 60 days of the machine sale date. 2. Enrollment in the program is completely voluntary and at the customer's discretion.
  3. An enrolled machine is eligible for the Cat Fuel Payback Credit for 24 months or 1500 hours, whichever occurs first, from the date of sale. After 24 months or 1500 hours, whichever occurs first, a machine will be automatically terminated from the program.

If a machine is operating outside of an area with communication coverage issue and Caterpillar is not able to collect remotely the Cat Product Link data within the reporting period, the program will default to only the data collected during the reporting period. Enrolled machine data will be used to track fuel burn and can be used by Caterpillar for analysis purposes including but not limited to fuel consumption averages and benchmarks. At any time during the enrollment period, the customer can access machine fuel consumption data via the free access to VisionLink Daily also included as Option I-c of this program.
  6. The amount of credit is contingent upon the machine's fuel consumption rate, as measured through Cat Product Link, for the first 24 months or 1500 hours of operation whichever comes first, following the date of sale. Caterpillar will issue customers credit certificates in amounts that correspond to gallons or liters burned during the enrollment period. The credit will be calculated at $2.259 USD/gal for machines purchased from a Cat dealer in the USA. The credit will be $1 CAD/liter for machines purchased from a Cat dealer in Canada.

Cat prepaid credits will be issued twice a year and each year thereafter for the duration of the program (unless terminated early by customer). The customer will receive a Cat commercial account credit certificate in the mail with their Fuel Payback Credit. This credit certificate may be used at any Cat dealer in the USA or Canada whose currency matches that of the currency issued on the credit certificate to pay for parts, services, and rental of equipment. The credit may not be used towards the purchase of a new machine. The Cat commercial account credit certificate will be sent to the address provided by the customer at the time of enrollment. If a customer's address changes during the duration of the program, it is the customer's responsibility to update the contact address via the program website. A customer
