Giveaway terms and conditions “Official Rules”

1. The Promoter

The Promoter is: Caterpillar SARL

2. The Promotion

2.1 The title of the promotion is “Cat® Coin Giveaway”.  

2.2 10 winners will be randomly selected.

3. How to enter

3.1 The promotion will run from:

08:00 GMT on 7th April, 2025 (the "Opening Date") to 23:59 GMT on 13th April, 2025,  (the "Closing Date") inclusive.

3.2 Entries must be received by the Promoter, between 08:00 GMT on the Opening Date and no later than 23:59 on the Closing Date for the relevant giveaway. All entries received before the Opening Date or after the Closing Date for the relevant giveaway are automatically disqualified.

3.3 To enter the promotion, the participant must complete the following steps:

    1. Follow Promoter’s Instagram page

    2. Like the Instagram post; and

    3. Tag a friend in the post’s comments

3.4 No purchase is necessary to enter the promotion. A purchase will not increase your chances of being selected.

3.5 The Promoter will not accept:

    (a) responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

    (b) proof of posting or transmission as proof of receipt of entry to the promotion.

3.6 By submitting an entry, you are agreeing to be bound by these terms and conditions.

3.7 Ten (10) winners will be selected at random from the promotion entries received between the Opening Date and Closing Date for the relevant giveaway.

4. Eligibility

4.1 The promotion is open to individuals who at the time of entry are at least 18 years of age and a resident of France, Germany, Spain, Netherlands, or the United Kingdom, except the following are not eligible to enter:

    (a) employees of the Promoter or any of its holding or subsidiary companies;

    (b) employees of agents or suppliers of the Promoter or any of its holding or subsidiary companies, who are professionally connected with the competition or its    administration;

    (c) members of the immediate families or households of (a) and (b) above;

    (d) attendees of the Bauma 2025 trade fair; and

    (e) government entities, public institutions and their employees.

4.2 In entering the competition, you confirm that you are eligible to do so and are eligible to claim the prize in accordance with these terms and conditions. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.3 The Promoter will not accept competition entries that are:

    (a) automatically generated by computer, script, bots, or any other automated process(es);

    (b) completed by third parties, whether singularly or in bulk;

    (c) illegible, have been altered, reconstructed, forged or tampered with;

    (d) photocopies, faxed, screenshots, or not originals in any way, shape or form;

    (e) infringing upon the intellectual property, privacy or any other rights of any third party, and / or contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening; or

    (f) incomplete.

4.4 There is a limit of one entry to the giveaway per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 Entrants must have an open Instagram account for the Promoter to track the entries.

4.6 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition. The decision of the Promoter in this regard shall be final.

5. The prizes

5.1 The prize for the giveaway will be 10 Cat® coins exclusive to Bauma 2025, 1 coin per winner.

5.2 The Promoter reserves the right to substitute a prize with a prize of equal or greater value.

5.3 The total approximate value of all prizes is $40.00 (forty USD).

5.4 All applicable taxes, including but not limited to federal, provincial, state and local income taxes, on the prizes are the sole responsibility of the respective winners.

6. Winner announcement

6.1 The winner of the competitions will be announced on Instagram on:

17th April, 2025 (the "Announcement date").

6.2 The decision of the Promoter is final and no correspondence or discussion will be entered into.

6.3 The Promoter will contact each winner personally as soon as practicable after the Announcement Date, using the Instagram profile provided with the competition entry.

7. Claiming the prize

7.1 Please allow thirty (30) days for delivery of the prize.

7.2 The Promoter will make all reasonable efforts to contact each winner. If the winner cannot be contacted or is not available, or has not claimed their prize within twenty (20) business days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

8. Data protection and publicity

By participating in the Promotion, each entrant (i) grants to the Promoter and its respective authorized agents the right to use his/her name, email address, and telephone number (“Personal Information”) for the purposes of administering the Promotion including, but not limited to, contacting and announcing the winner and fulfilling the award of the prize; (ii) grants to the Promoter the right to use his/her Personal Information for publicity and promotional purposes relating to the Promotion, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledges that the Promoter may disclose his/her Personal Information to third-party agents and service providers of the Promoter in connection with any of the activities listed in (i) and (ii) above. Personal information will otherwise not be sold, shared or disclosed in any manner or for any other purposes by the Promoter or any related entities, unless entrant has otherwise agreed. The Promoter will use the entrant’s Personal Information only for identified purposes and will protect the entrant’s Personal Information in a manner that is consistent with the Promoter’s privacy policy. 9. General

9.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude entrants from participating in the competition.

9.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize promotion where it becomes necessary to do so.

9.3 FACEBOOK®, INSTAGRAM®, LINKEDIN®, AND TWITTER®ARE NOT AFFILIATED WITH THIS PROMOTION, ARE NOT RESPONSIBLE FOR THE ADMINISTRATION OF THIS PROMOTION, ARE NOT RESPONSIBLE FOR PROVIDING ANY PRIZES, AND ARE NOT A SPONSOR OF THIS PROMOTION.

9.4 Neither the Promoter, nor any of its affiliates, agents, or suppliers,  accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the promotion or as a result of accepting any prize and shall not be responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation in the promotion. Nothing shall exclude the Promoter, or any of its affiliates’, agents’ or suppliers’ liability for death or personal injury as a result of its negligence.

9.5 These terms and conditions shall be governed by the law of England and Wales, and the parties submit to the non-exclusive jurisdiction of the courts of England.

10. Release Indemnity

By participating in the Promotion, all entrants, including without limitation the winners, agree to release and hold harmless Facebook©, Instagram, the Promoter and its and their parents, subsidiaries, limited liability and affiliate companies, dealers, its advertising and promotional agencies, and each of their respective employees, shareholders, directors, officers, members, personnel, agents, attorneys and assigns (collectively, the “Releasees”) from any and all damages, injuries, claims, causes of action, or losses of any kind resulting in whole or in part, directly or indirectly, from such Entrant's participation in the Promotion, any breach of these Official Rules, the acceptance, possession, use or misuse of any Prize, including without limitation: personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity and privacy. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT OR

CONSEQUENTIAL DAMAGES; LOSS OF DATA; INCOME; OR PROFIT; LOSS OR DAMAGE TO PROPERTY; CLAIMS OF THIRD-PARTIES, AND ANY OTHER DAMAGES, AND THE RIGHT TO HAVE ANY DAMAGES MULTIPLIED OR OTHERWISE INCREASED. The entrant further agrees to fully indemnify the Releasees from any and all claims by third parties relating to the Promotion, without limitation.

11. Limitation of Liability

By entering the Promotion, each entrant (i) acknowledges compliance with these Official Rules, including all eligibility requirements; (ii) agrees to be bound by the decisions of the Promoter, which are final and binding in all respects; (iii) agrees that the Promoter has sole discretion to resolve any disputes as it sees fit; and (iv) agrees that neither the entrant nor his/her heirs, successors, or assigns will assert any claim related to damages, losses or injuries against either Facebook©, Instagram, Twitter, LinkedIn, any other third party platform or the Sponsor or its or their parents, affiliates, franchisees, advertising or promotion agencies, attorneys, prize providers and affiliated entities, and each of their respective employees, shareholders, directors, officers, members, personnel, agents and assigns. The Promoter and its related entities, parents, subsidiaries, limited liability and affiliate companies, franchisees, advertising and promotion agencies, attorneys, prize providers and affiliated entities: (i) make no warranty, guaranty or representation of any kind concerning any Prize; (ii) disclaim any implied warranty; (iii) are not in any way responsible or liable for damage, loss or injury of any kind including, but not limited to death or bodily harm, actually or allegedly arising from entry into the Promotion or acceptance and/or use of any prize; (iv) disclaim any responsibility for any actual or alleged loss (financial or otherwise), injury or damage to persons or property which may be caused directly or indirectly, in whole or in part, from downloading any material from any website, social media site, or the website, regardless of whether the material was prepared by the Promoter or a third party, and regardless of whether the material is connected to the website or social media site page by a hypertext link; and (v) disclaim any liability for either for the termination, suspension or modification of the Promotion for any reason or through the acts or defaults of any company or person fulfilling any portion of the prize.
